Terms and Conditions
The following terms and conditions are intended to be
fair to all parties concerned and apply to all website
design services offered by Waco Web Designs. By requesting
services from Waco Web Designs you are agreeing to the
following terms and conditions.
Guarantee Web Site Design:
Due to the high standard of our web design work we have the
confidence to guarantee all our web design work. Once we
have completed the design, you will have the opportunity to
view the site for approval. If at this time you are not
completely satisfied with the appearance and functionality
of your web design or if the design we provide does not
meet or exceed your expectations, Waco Web Designs will
continue to work on your site at no additional charge until
it does. We can't be any fairer than that. We take pride in
all our satisfied clients and look forward to giving you
the same level of service excellence.
- We reserve the right to refuse to construct a
website which we may judge as unfit due to content or
otherwise. This includes, but is not limited by, sites
containing adult oriented material such as pornography,
sites which promote hatred towards persons belonging to
any ethnic group, religion or sexual orientation and
sites which infringe copyright or are contrary to USA
laws.
- The acceptance of a commission shall be deemed as
a contractual agreement between the client and Waco Web
Designs and a contract will be signed upon agreement
between both parties.
- Waco Web Designs cannot always guarantee to start
work immediately on a commission but will arrange a date
with the client as to when work can commence and will be
stated in a written contact.
- Text may be submitted on disk or e-mailed in
standard word processing format, or typewritten, printed
brochures and other printed materials. Photos and
graphics may be submitted to us on diskette in any of
the standard graphic formats or e-mailed directly to
Waco Web Designs. Paper format should be the highest
quality artwork or photos available in order for us to
scan. Make sure your originals are clear and clean.
Graphics will be resized to conform to your web page. We
will not accept graphics smaller than 2” x 2” or larger
than 8.5” x 11”. All material, both text and images,
supplied by the client and used in the construction of
the client's website, will remain the client's property.
All such material will be assumed to be the property of
the client and free to use without fear of breach of
copyright laws.
- The copyright for all material provided by Waco
Web Designs , such as HTML code, graphics, photographs
and text, will remain the property of Waco Web Designs
until such time as payment has been made in full
whereupon they will become the property of the client.
- Waco Web Designs makes every effort to design
pages which display acceptably in the most popular
current browsers, but cannot accept responsibility for
pages which do not display acceptably in new versions of
browsers released after pages have been designed.
- Waco Web Designs will submit a client's website
to several of the major search engines as part of the
design commission. If a client wishes Waco Web Designs
to promote a website as a separate commission, Waco Web
Designs will make every reasonable effort to promote the
website effectively but cannot guarantee high placing in
search engine results.
- Waco Web Designs can accept no responsibility or
liability if any search engine, online directory or
search site, submitted to as part of a website promotion
commission, chooses not to list a client's website.
- Waco Web Designs will initially place the
client's website on one of Waco Web Designs'
demonstration server during development in order that
the client may view and comment upon the website's
progress. When both Waco Web Designs and the client
agree that the website meets the criteria agreed to in
the contract, Waco Web Designs will invoice the client
for the balance due for the commission. On receipt of
payment, Waco Web Designs will publish the website on
the client's host server, or provide the source code for
the site on CD-ROM disk for the client to upload at a
later time.
- If at any point during website development a
client wishes to cancel, they may do so but will be
invoiced an amount that Waco Web Designs judges to be
proportional to the amount of work completed on the
commission.
- If, during website development, the client does
not supply the content required in order to complete the
website within a reasonable amount of time, Waco Web
Designs will consider that the client wishes to cancel
the website.
- Payment methods accepted are check, credit cards
and cash. Please make checks payable to Waco Web
Designs. Payment is due in full within 30 days of the
statement date, and will be considered past due
afterwards. Past due accounts will be assessed a late
charge at the rate of 10% per month on the past due
balance (minimum charge is $10.00).
- Waco Web Designs reserves the right
to suspend any or all services, until payment is
received in full. Any payment returned by the bank or
credit card company will incur a $30 administration
charge. This will be invoiced and will be added to the
total outstanding debt owed by the customer.
- Waco Web Designs does not undertake to maintain
or update a client's website as part of the design
commission. If a client wishes Waco Web Designs to
maintain or update a website as a separate commission,
Waco Web Designs will negotiate with the client a
maintenance contract appropriate to the amount of work
required. Website maintenance may also be undertaken on
a time and materials basis if the client so wishes.
- Waco Web Designs reserves the right to alter
prices at any time without notice. If a client has
commissioned any services from Waco Web Designs prior to
a change in prices, that commission will not be subject
to any increase, but any subsequent commission may be
subject to an increase.
- A link to Waco Web Designs will appear in small
type and/or graphical format at the bottom of each page on the website. The link will not cause users to
leave the Client website, rather, it will open a new
browser window to the Waco Web Designs website or e-mail
address, at Waco Web Designs discretion. The link will
typically state, "Website by Waco Web Designs." This link
may not be modified at any time without express written
consent of Waco Web Designs during the existence of the
website for public viewing. Additionally, design credits
to Waco Web Designs will also be in the HTML code of
each page, hidden from normal view, and may not be
modified at any time without express written consent of
Waco Web Designs during the existence of the website for
public viewing.
- Waco Web Designs cannot accept responsibility for
any alterations caused by client or third parties
occurring to the clients pages once placed. Such
alterations include, but are not limited to additions,
modifications, deletions, stolen content, stolen domain
name or hosting failure.
Waco Web Designs reserves the right to change or
modify any of the terms and conditions. All content on this
website, including the elements of design and layout unless
otherwise noted, is copyrighted material and may not be
reproduced or imitated in whole or in part. Legal action
will be pursued against violators to the extent the law
allows.
If you have any complaints about the quality of service you have received from Waco Web Designs please e-mail or write to us stating the full
nature of your complaint. We take customer satisfaction
very seriously and will investigate your complaint promptly
and thoroughly.
